User Agreement

Welcome to Tiger Learners! We connect individuals (students) who want to learn or improve their english with a native english speaker (tutor) who will help them learn with real time video chat language tutoring sessions (tutoring services). This User Agreement (agreement) applies to both students and tutors, and where students are minors/children under the age of 18, their parent or legal guardian.

Please review this agreement in its entirety. By accessing this website or registering for a user account, you acknowledge that you have read, understood, and agree to this agreement.

If you do not agree to all of the terms and conditions of this agreement, you may not use this website.

1. Eligibility

You may use the website only if you can agree to the terms and conditions of Tiger learners.

If you are a student, you represent that you are under the age of 18 years old and have been given parent or legal guardian consent to use it. Over the age of 18 years old and have provided consent and agreed to this agreement.

2. Additional Terms and Guidelines

When using this site, you are subject to any additional post guidelines or rules applicable to specific services, offers, and features (the guidelines).

3. Data Privacy

Tiger Learners privacy policy is incorporated into this agreement. Please read this notice carefully for details relating to the collection, use and disclosure of your personal information.

Tutors are data controllers. Tutors will receive personal data of students in the course of tutors providing and students receiving tutoring services. With respect to any personal data obtained by the tutor pursuant to this agreement, the tutor agrees to independently comply with its obligations as a controller of students personal data.

4. Modifications

Tiger Learners may make modifications to this agreement (changes) at any time. Except as explicitly provided in this agreement, such changes will be effective as to existing users after Tiger Learners provides notice of changes, either through the platform user interface or sent to the email address associated with your user account; and when you opt-in or otherwise expressly agree to the changes or a version of this agreement incorporating the changes. If you provide written notice that you do not accept a proposed change or decline to expressly agree to a proposed change, Tiger Learners may terminate this agreement and your use of the website.

5. Account Registration and Use

Student Registration. The website allows students to request and engage in a video session with a tutor for the purpose of learning and practising conversation skills in english. To access a session with our tutoring services, you must register and create an account through the platform. Registration may require you to: (i) create a unique user name and password, (i) provide an email address, (iii) indicate your current country of residency, (iv) indicate your native language, (v) indicate your age, and (vi) indicate your gender. Note that Tiger Learners does not have access to your payment card information, as we use a third-party payment processor to receive and process payments.

Tutor Registration. To become a Tiger tutor, tutors must register and create an account through the site. As part of the registration process, we may require a tutor to: (i) create a unique user name and password, (ii) provide an email address, (iii) indicate current country of domicile, and (iv) indicate that tutor is at least eighteen years of age.

Registration Accuracy. You agree that the information you provide, at all times, will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept confidential, accurate and up to-date at all times.

Password. When you register, you will be asked to provide a password. You will agree to accept full responsibility for all activities that occur under your account.

Personal Use. Except as provided herein, Tiger Learners accounts may only be used by the user who registered for that account. Lessons purchased by a student may only be used by that student in that student's account. If you have friends or family members wanting to try a lesson with Tiger Learners a separate account for them must be set up.

Tutors provide materials. You understand that, except as otherwise specifically agreed between student and tutor, that the tutor will provide all learning material to perform the tutoring services agreed upon with students. Tiger Learners will also provide both student and tutor with access to the website to facilitate access to available, optional support resources and materials.

6. Rules and Prohibitions

You may not:

Utilise any Tiger Learners material without our written consent, including framing techniques, logo and worksheets

7. User Content

By posting user content on or through the platform, you grant Tiger Learners Ltd royalty-free license with the right to use, copy, reproduce, display and otherwise use whenever they wish. In the interest of clarity, Tiger Learners shall remain access to your account even after it is terminated. Notwithstanding the license granted to Tiger Learners in user content and for avoidance of doubt, our use and retention of your personal data, including any that is contained in user content, shall also be governed by and comply with the Tiger Learners privacy policy. You represent, warrant and agree that you have given permission to use your posts and other content uploaded.

8. License to use the website

Subject to your compliance with the terms of this agreement, Tiger Learners gives you limited access to use the website as provided to you.

9. Ownership and Proprietary Rights

The website is owned and operated by Tiger Learners Ltd. Any feedback, comments, questions, or suggestions (collectively, "feedback") you may provide regarding the website is entirely voluntary and we will be free to use such feedback, comments or suggestions without any obligation to you. By sending us any feedback, you further (i) agree that we are under no obligation of confidentiality, express or implied, with respect to the feedback; (ii) acknowledge that we may have something similar to the feedback already under consideration or in development;

10. Sessions

Engaging in a session requires a compatible hardware and may require the download and installation of specified software. You are solely responsible for acquiring and installing such software and for determining compatibility with your system. If you run into any difficulties when lesson begins and the lesson is cut short the time used will be deducted from the lesson.

Session recordings. Sessions may be recorded or monitored. You hereby consent to: (i) the monitoring and recording of any session you engage in, including your likeness therein; (ii) Tiger Learners copying and using such recordings for purposes of providing the services, including without limitation for purposes of tutor evaluation, tutor training, dispute resolution and improving the website; (iii) such recording being made available to the other party in the session, including the student or the student's legal guardian; (iv) such recordings being made available for you to review.

11. Payments on the website.

Payment. Students pay for tutoring services by the payment plan provided through the website. Payment will occur through a third-party payment system. All payment terms and conditions are governed by your applicable agreements with the third-party payment system, as applicable. Fees displayed to you are GST inclusive and you agree to pay Tiger Learners the cost of the lesson plan you have abided by.

Payment Plans. We may provide students with an option to sign up for a payment plan in which a designated amount will be charged to a student account on a designated basis (payment plan). By signing up for a payment plan and providing us with your payment account information, you are signing up and agree to pay the amount designated for your particular payment plan. If your payment may be unsuccessful your lessons will be stopped until the due fees have been paid. You will not be able to have lessons unless you have paid before the lesson commences. An invoice will be sent to your provided email address at the end of each every lesson, however payments must be made before receiving this invoice.

Cancellations. You may cancel payments at any time in your account settings. If you fail to let us know that you are no longer wanting to take lessons and are booked in then you will be charged for that lesson.

No Refunds. Purchased minutes are non-refundable, and minutes used for the session are non-creditable. If you are booked in for a set time and need to finish your lesson earlier than that set time, you will not be able to pick up those minutes in the next lesson. If you however feel you have been charged in error, please contact tigerlearners@gmail.com.

Timing. If you are late for your lesson the time will not start when you begin but when it was booked for. If you do need to make a time change then you must give at least 24 hours notice or you will be charged for the lesson due to the last minute cancellation.

12. Tutoring rules.

Services to be performed. If you are a Tiger tutor with Tiger Learners you agree to use your best efforts in performance of your tutoring services, and you further agree to cooperate with Tiger Learners, not to interfere with the conduct of Tiger Learner's business, and to observe all Tiger Learners rules, regulations and security requirements with respect to the safety of students, other tutors and Tiger Learners.

13. General

Notices. Under this agreement, you consent to receive communications from Tiger Learners electronically. Tiger Learners will communicate with you through email, Kakao talk or by posting on the site and social media platforms.

Language. Any action brought under this agreement shall be conducted in the english language.
